Terms and conditions

These conditions govern enrollment in the programs and the field experiences of Istituto Belmonte. They are read before enrolling and accepted when the contract is signed. Where these conditions and the signed contract say different things, the signed contract prevails.

2. Who buys, and why that changes everything

There are two cases, and the conditions are not the same.

Case A, an institution buys. The contracting party is the university, the student association or the body bringing the group, and the contract is signed by whoever has authority to sign it. The individual participant is not a party to the contract. Invoicing and payment follow the institution's own administrative procedure. In most cases a student association cannot receive an invoice or authorize a payment on its own, and the file goes through the competent office of its university.

Case B, an individual buys. The contracting party is the participant, who must be of age. In this case the contract is concluded at a distance with a consumer, and the protections of the Italian Consumer Code apply, including those in point 6.

3. What is being bought

The exact object is in the program page, which states duration in days, hours of taught activity, modules, locations, language of delivery, minimum and maximum number of participants, and what the price includes and what it does not include.

The program page counts as the contractual description. If we change something substantial after signature, we say so in writing and whoever signed may withdraw without penalty.

4. Enrollment

Three steps. Pre-enrollment, with the form and the documents, with no payment of any kind. Assessment, with a twenty-minute online interview and the outcome in writing within five working days, with the reason if it is negative. Confirmation, with the signed contract and the deposit.

Requirements. Eighteen years of age on the departure date, a valid passport with at least six months of validity beyond the planned return date, current university enrollment or a secondary school certificate, and a language level checked in the interview.

5. Price and payment

The price is published once the treatment of the tax is settled, because a price without the treatment of the tax is an incomplete price, and an incomplete price is an omission (article 22(4) of the Italian Consumer Code). When it is published, it is published inclusive of tax, with the list of what it includes and what it does not.

6. Right of withdrawal

In case B, where an individual buys, the contract is concluded at a distance with a consumer and the Italian Consumer Code provides as a general rule fourteen days to change your mind, with no reason given and at no cost, from the conclusion of the contract. It remains to be verified whether the program falls within one of the exceptions in article 59, in particular the one on leisure services with a specified performance date. Until that check is closed, this page recognizes withdrawal in the form most favorable to the consumer, that is, a full fourteen days.

In case A, where an institution buys, there is no consumer and the statutory right of withdrawal does not operate. The cancellation conditions in point 7 apply.

How it is exercised, where it applies. A written communication to programas@istitutobelmonte.com within the deadline. We refund within fourteen days of receipt, using the same means of payment, withholding only the unrecoverable costs already incurred and documented at your explicit request.

7. Cancellation

By the institution or the participant. [—] Table of thresholds and penalties, to be defined with the model contract. We are not improvising it on a web page. The criterion is the one we would use in any case: the penalty covers the costs that at that distance from departure are no longer recoverable, and they are declared in advance by band of days rather than calculated afterwards.

Replacing a participant. Allowed up to 15 days before departure, at no cost, with the substitute's documents.

By us. We can cancel only for failure to reach the minimum number of participants, which is 8, and we give notice at least [—] days before departure. In that case we refund in full what has been paid, within [—] working days, with no deductions. We owe nothing further, save as provided in point 8.

8. Force majeure

If an event beyond the control of both parties makes running the program impossible or unsafe, neither party is liable for non-performance. In that case we propose, in this order, rescheduling to a later date, or a refund of the sums paid net of documented and unrecoverable costs.

The list of events and the exact mechanism are published here before enrollment opens. A generic clause does not cover a multi-country group trip, where the risks are concrete and known in advance, from airport shutdowns to border closures to health restrictions.

9. Entry and visas

Visas are issued by consulates, not by us, and the decision is theirs alone.

For a stay of up to 90 days in any 180, nationals of the countries listed in Annex II to Regulation (EU) 2018/1806 do not need a visa to enter the Schengen area. The count is cumulative across the whole Schengen area, not across Italy alone, and anyone who has already traveled in Europe in the previous six months may not have days left. The detail, with the sources, is on Entry, visas and residence permit.

What we do. We prepare the acceptance letter with duration, syllabus, weekly hours and the type of final certificate, in the format the consulate requires. What we do not do. We do not obtain visas, we do not guarantee them and we do not speed them up.

A visa refusal is not a failure on our part. What happens in that case, in refund terms, is set by the table in point 7, which today does not exist.

10. Insurance

[—] Table of our cover, with insurer, policy number, sum insured and expiry. It is filled in with the real policy figures, never with generic formulas, because cover declared without a sum insured is not information.

What the participant must hold on their own account, and what is instead included, is written in the quotation and in the contract, and can be asked for in writing before enrolling. The insurance and cover page is not published yet for the same reason.

11. Obligations of the participant

Respecting the rules of the venues, the companies and the places visited, which often have protocols of their own. Not recording or circulating images inside the companies visited without written authorization. Reporting health or accessibility needs relevant to safety. Respecting the laws of the host country.

We can exclude from the program anyone who puts their own safety or that of others at risk, with no refund and with written notice to the home institution.

12. What we certify, and what we do not

At the end the Institute issues a certificate of attendance. It is issued from 80% attendance upwards, and the real percentage stays written on the document.

The program does not lead to any qualification with legal validity, in Italy or in any other country, and carries no academic credits. The reasons, in full, are in Academic notice. Whoever signs these conditions declares that they have read that page.

13. Intellectual property

Teaching materials are ours or belong to whoever licenses them to us, and they are for personal study. They are not redistributed or used commercially without written authorization.

The work produced by the participant stays theirs. We can quote it or show it only with their written consent, which can be withdrawn.

14. Complaints

Write to institucional@istitutobelmonte.com. We answer within five working days with the status of the file, and within thirty days with a substantive reply.

15. Governing law and jurisdiction

Italian law applies.

[—] Competent court, to be defined. With a consumer resident in a Member State of the European Union the mandatory forum is the one where they live, and no clause can move it. With a foreign institutional buyer the clause is negotiated, and it has to be drafted so that it is enforceable. Both cases are closed before the first contract is signed.

This program does not lead to any qualification with legal validity. Istituto Belmonte is a private training institute. Its programs do not confer qualifications with legal validity in Italy or in any other country and carry no academic credits. A certificate of attendance stating hours and content is issued at the end.
